The Kansas Court of Appeals has ruled that a Wichita man convicted of second-degree murder will get a new trial.

In the ruling, the court found Oklahoma Highway Patrol troopers did not have probable cause to search the Cadillac 32-year-old Felton Williams Jr. was driving. The Hutchinson News reported that the search happened hours after the September 2008 shooting of 21-year-old Kenneth "Landy" White at his Hutchinson home.
The search yielded $2,000 worth of cocaine and two guns reported stolen from Hutchinson. One of the weapons was a .40-caliber gun that authorities allege was used to kill White.
The appeals court also rejected Reno County District Attorney Keith Schroeder's argument that the odor of alcohol on Williams gave troopers probable cause, under Oklahoma law, to search Williams' vehicle.

ARE YOU FUC@#$ KIDDING ME!!! I wonder what the hell these morons are smoking??!! The SOB is caught with the damn gun that killed the guy---AND WE ARE GIVING HIM A NEW TRIAL BECAUSE SOMEONE VIOLATED HIS RIGHTS BY SEARCHING THE CAR!!!?? I totally understand the need to be sure people are not being illegally searched--for no reason. But--this guy--REALLY???!!! Its this kind of crap that make people want to seek out their own justice!!

Yep Granny, your comments are right on track. For thirty years I put up with walking on egg shells not to violate a person rights. O hell yes, the criminal does have more rights than you, me, and others. Some of the more better legal minds are in prison. That is all they have to do, research case law. By the way, most prisons have better up to date law books than most attorneys. Of course those law books are paid for by taxpayers like you and me. Makes you feel good those taxpayer provided law books are helping criminals get out of prison, that may have violated you or your family. Sucks big time Granny, thanks to our supreme court and their liberal decisions. Kinda like their reference to burning the American Flag, well you should not do it but if you do, one is only expressing their amendment rights. BS
