A Kansas military school is again asking a federal judge to dismiss a lawsuit by families of 11 former cadets alleging physical abuse.

Lawyers for St. John's Military School in Salina filed a motion Wednesday seeking dismissal of the lawsuit or an order putting the dispute into arbitration.

The move is largely procedural since U.S. District Judge John Lungstrum denied a similar motion in June. The school says it renewed the request because four new cadets have since been added to the case and it wanted to preserve all legal issues for a potential appeal.

St. John's has denied allegations that higher-ranking students were encouraged to discipline younger cadets, leading to abuse.

Why doesn't this magistrate judge just add everyone who ever attended St John's to the lawsuit. I cannot believe we have so many incompenant federal judges sitting in judgement when they could not judge a baby beauty contest.

Procedural or whatever, I hope this one makes it's way to court soon so everyone can find out just who is lying. I don't think there is going to be any out of court settlements. So let's get it on in court without delay since it appears the judges are not going to dismiss these lawsuits.

Judge Lungstrom is a brilliant man and a Salina native who earned his way onto the list the best and most respected federal judges in the Country. This was just a pro-forma motion to preserve issues for appeal. It is very difficult to have a lawsuit like this dismissed with the simple notice pleading standards that apply in federal court. It will be interesting to see whether there will be enough evidence to defeat a motion for summary judgment for the school.

Queeny you are soooooo stupid. And sooooooooo boring. What about that name, address, phone number of your? I bet we find out that these kids were being hazed without the school having knowledge of the hazing until this group of plaintiffs came forward. Anyone who has been in the service know these types of rituals are not uncommon.
