City Commission Changes Ordinance To Include Gay, Lesbian, Transgender

A small group of protesters gathered outside the Salina Community Theater late Monday afternoon as Salina City Commissioners and a large crowd gathered inside to discuss, and to make a decision on a proposed controversial ordinance change. Commissioners were considering changing the city anti-discrimination ordinance.
Commissioners heard well over two hours of testimony from numerous people both for and against the change. Some of the testimony was very passionate.
Salina Community Theater Executive Director Michael Spicer estimated the crowd to be at around 200 people.
Ultimately, by a 3 - 2 vote, commissioners elected to change the anti-discrimination ordinance to include sexual orientation and gender identity. The ordinance will prohibit discrimination of gay, lesbian, or transgender residents in the areas of employment, housing and public accommodations.
Vice Mayor Barb Shirley and Commissioners Aaron Householter and Kaye Crawford voted for the ordinance change. Mayor Norm Jennings and Commissioner Samantha Angell voted against it.
Monday's meeting was the culmination of several months of discussion, and public meetings on the issue. As part of the process, the city hosted three public forums on the issue.
The Salina Human Relations Commission also twice discussed the issue. Those commissioners voted 7 - 1 to recommend that the city pass the ordinance change.
Prior to to the public forum, Salina City Manager Jason Gage said that those opposed to the ordinance change could ultimately get it put on a ballot for a public vote to overturn via a petition drive. He advised anyone considered doing that to first contact the city attorney.

Time to get the recall petitions out. These 3 commissioners need to be gone. Aaron and Barb definately as they both lied to us to get elected and its time they are recalled and we get people in there who have the majority of the taxpayers wants and concerns in mind not a few special interest groups. As for Kaye she has been making bad decisions far to long and goodbye to her also.

So let me get this right, now men who think they are women can go into public womens roons and locker rooms, and women who think they are men can go into mens roons? hmmmm, Dont think thats a good idea. This has been overturned in every city that has tried it, i dont think the commisioners are voteing for the majority of the people in Salina, special rights for special groups is NOT the American way!!!!! I know I only said one point, I could go on and on, but this is wrong, get it on the ballot and lets see what the people of Salina really want!!!

chainsaw you are so right. but lets look at this another way. old barb who voted for this will have guys sharing her stall in the women's rooms she goes in. I hope she remembers when this occurs how she voted and that she will be gone off the commission shortly. It does not pay to get elected any longer by misrepresentation of one's self. As for Aaron he to will probably see some transgenders in the men's room with him. But he may enjoy it he's such a wus. I will be looking for the recall positions to sign.

Interesting, on the Salina Journal site, where peoples names are with their posts, they are supportive of this action. Here on KSALLINK where people can hide who they are, they are not supportive. I dont know what ROCKER wrote, but dont think they are ROCKING anymore :)

Have any of you used a public bathroom @ a kwik shop lately? They already have unisex bathrooms, people wake up its not about what u think about any one but your selves. Take care of your own and let it be.I mind my own business, now can't you do the same? As I have said throughout this whole thing, You can pass any ordinance you want, but you cannot control what people think and feel in regards to ANY issue. People that make a choice to not accept this will not change their minds all of a sudden and decide it's ok just because they put an ordinance in place. The ones that were in support of this better not get too comfortable with it because I have a feeling when those flood gates open up, this ordinance will be reversed. It will not affect me personally one way or the other because I will be one of the ones that will not be changing my mind on this issue. This may feel like a victory to the Gay/Lesbian/Transgender supporters, but I suspect there will be some problems down the road on this.

So all a sexual offender has to do is claim that they were not rented to because they are homosexual and they get to live wherever they want. I'm not saying that homosexuals are sex offenders-I'm just saying that this opens the door to anyone and everyone that wants to do perverted things. Since there is no physical proof that you are homosexual, no one can dispute your claim. I have to agree with Andrew Couch--we need to wait and see what the state does, because if their bill passes as it is, this will all be a moot point. We do not need legislation to condone sin. Murderers have claimed that they can't help it-God made them that way-for years and years, do they get special treatment? Are we going to have to let them out of jail for their crimes because now they are being discriminated against?

It seems a petition is being worked on which will be presented to the commission, It needs a percentage of signatures of the last election that people voted probably about 5000. If that is gotten then this has to be put to a public vote. Also if the commissioners refuse to accept it this ordiance is null and void.

A point was made by one of the people commenting that life for the 3 commissioners as they had it in salina is about to change. Also sadly life that many of the gays living here also will be changing and not for the good. As many of us already know and we are not gay is that job lose in a bad economy just happens and there is no law to protect you from that. It seems old Aaron seems to be the most vocal well good luck to you. Next is old Barb who has become a turn coat since being elected. Both of you are gone so if you make it to the next election do not waste your money running again. As for the 3rd person Kaye your gone but you just do not know it. We do not need people like these three serving on our commission. Remember look for the petition when it comes out and lets all sign it so we can vote on this.

now to those who care little to understand what LGBT means! first lose the term "lifestyle" to describe any Lesbian Gay Bi sexual or Transgender person "lifestyle" suggests choice LGBT people did not have that option at birth! and as far as a non Homosexual or Transgender person trying to use a restroomfor illicit use transgender people must under go a series of tests and are givin paper work stating that fact that they are transgender a true Gay male would be fairly obvious a Gay male would not use a female restroom!a transgender individual "person" for those with a pea brain and can only quote Bible scriptures is in fact born with the mind of a female the "body" of a male as well as a female to male transgender "person" Transgender people and Gay or Lesbian "people" are not pediophiles or sex addicts we are "people" who wish to be treated with dignity and respect we do not break the "laws" of the LAND perhapes the LAWS of your bible but that dosnt govern this country now does it!

Thank you to those three brave people for seeing that we may not all see eye to eye but that all people still deserve the same rights. You should never be discriminated against because of who you love. This is the 21st century, we should be past discriminating against anyone. For all you Christian folks out there, I believe Jesus preached love not hate. Maybe you should try an open mind and heart like us church people are supposed to have. Love one another despite differences.

Still no answer why we wasted so much time on this. We already have laws against discriminating. What a waste of time and money. So many other real issues here in Salina that truly need to be taken care of. Over abundance of DUI, Assaults, Stealing, Babies being murdered, Terrible roads, Businesses leaving. It is not a friendly place at all. Just read some of the posts. Why would anyone not from here ever want to come visit...let alone move here.

Well you gays ought to pay attention to history as it has a way of repeating itself. 100 years ago gay people were tared and feathered and rode out of town on a rail. This also happened to politicians as well. Today in some countries gays are stoned to death which is pretty severe. Let's talk about a few things that happened in the past: - women weren't treated equally - African Americans weren't treated equally - It was illegal to drink alcohol (remember prohibition (that means you can't drink alcohol))? Bottom line, the Genie is out of the bottle, can't put it back in. All you groups that think you should be a protected class, the door has been open for you. As a Senior Citizen, I would love to see a group organized that will fight for OUR rights!! I would love to go enjoy Kenwood Cove this Summer, however, I cannot take the risk of being trampled by so many children. I feel that is discrimination against the Seniors that we are unable to enjoy a City, tax funded facility. To the ones that were supporting this issue, be careful what you wish for!!! To the City Attorney, better start clearing your calender, I suspect you will be pretty busy in the upcoming months.

Most of you need to read this article again. The ordinance that was passed "prohibits discrimination of gay, lesbian or transgender residents in the areas of employment, housing and public accommodations." See the fourth paragraph. Basically a business can't discriminate based on an individuals sexual orientation, nor can landlords or those who rent out housing. They already can't discriminate against race, religion, nationality etc, why would adding these to the list make any difference? Also, I don't know where some of you got the info about gay men using women's restrooms and locker rooms and vice versa, but it seems to me like your just making stuff up because your as ignorant as they come in this world. And really, is any of this going to have a direct effect on your life? Is your world going to be flipped upside-down because your neighbors are "partners"? Come on people!

@magicmike67: My basic rights get denied all the time. I have to get a virtual strip search whenever I fly. At one point in my life I could not rent a home because I had a bad credit score. I have a basic right to shelter don't I. As a teenager I was fired because I had long hair. I have a right to procreate but if I have more than one women that live in my home that bear my children I get arrested for it. If I wanted to ingest cannabis into my own body I would be arrested, even though the constitution grants me the right to my own body. If you disagree I hope your anti abortion then. Back on topic, every one has and will be denied basic human rights in the USA. It's not fair, but what is?

@FreeWill: Having a bad credit score is YOUR fault - you can fix it. So while housing is a "basic right" (and that's stretching it a bit), if you're score shows that you have trouble paying, they have the right to not rent to you! Also...you don't HAVE to fly - so don't go to the airport. I've had the airport pat down before...I'll agree, its not fun, but I didn't have to fly: that was a choice. I'll agree with you on the hair point (but only slightly) as it could be considered free speech. You DO have the right to your own body (i AM pro choice, by the way) - however, cannabis is currently illegal, so I'd bring up the rights of plants to someone if I were you. And as far as the procreation thing, it's technically only illegal if you marry them.

@Freewill. Your still not reading the article. This involves employment, housing and public accommodations. Business' can still refuse service to anyone based on anything they want..i.e. no shoes, no shirt no service etc. This ordinance affects job and housing applications so that the individuals applying won't be discriminated against based on their sexual orientation.

The simple fact is, we are ALL discriminated against in some form or another on a daily basis. It would be unreasonable to think there could be a law to protect every single form of discrimination. If you are a victim of a crime today, the criminal that committed the crime against you has way more rights than you as the victim, a form of discrimination. I am a white senior citizen woman, we are amongst one of the most discriminated against groups. If I was a young, child bearing woman, I could pop a few kids and get all the assistance I need and want.

I do not care if you are Gay, Lesbian, Transgender, Black, White, Brown, Christian, Jewish, Fat, Skinny, Tall, Short, Long hair, short hair, educated, uneducated, rich, poor, employed, unemployed, Vegan, Vegetarian, Meat eater, Drug dependent, alcoholic, mentally challenged, physically disabled, married, single..... We have all and will all at some point in our lives be discriminated against in some form. Should we all be able to seek an ordinance to protect us?

I just wonder how many of you would open up your closed minds, if your son, daughter, brother, or sister had been treated unfairly because of their lifestyle choices, or the appearance of life style choice. Would you be the first one raising hell because your loved one was denied an apartment of their choice, the best job, or medical care? I don’t see any where in this article it says it’s okay for a man to use a woman’s restroom, or locker-room. These are comments that are off-topic, and created by homo-phobic individuals that are using this forum to voice their opinions. (which by the way is a basic right thanks to the constitution that at some point was opposed) All this ordinance is doing is protecting EVERY HUMAN from discrimination. Besides everything that has been mentioned at getting back at the rogue commissioners the best way to do it now that they have done this is for groups any groups get the right number of signatures on a petition and approach the commission or their bias heritage group and ask for a special addition be added to the ordinance. If they refuse to do so then hit them with a discrimination lawsuit as they did it for the gays so now they set presidence and they have to do it for everyone or group. After enought lawsuits get filed I believe the pressure would be so great the 3 rogue commissioners will resign.

I am surprised this little town has so much hate. Christians just cannot keep their nose out of everyone elses business. Not every person in the world is a christian or white or rich or straight! You say the lgbt community doesn't need their rights protected but your comments and ideology prove otherwise. It would be nice if Salina could be a progressive society.Maybe you can make some gays only signs for the bathrooms and some tranny water fountains. WTF is wrong with you people that you don't think all of our citizens have the right to happiness and to be protected from DISCRIMINATION? Kansas is a hire/fire state and you can be an employer of a gay person and if they don't do their job you can fire them. Most people that try to live by Jesus' don't have a problem with all people having the same rights as human beings. Its only a small percentage that's make the news with radical protests and beliefs. magicmike the gay community is now fair game with targets all over them. Everybody did co-exist in Salina but this group wanted to be special. There has never been any complaints about discrimination as far as jobs, housing or anything else so this all was to push their movement in all our faces nothing else. Now they opened a can of worms and people are not happy to say the least.

getoutside.... any male person now can enter a woman's toilet or locker room under the guise of being a transgender whether they are or not and the owners of these business's are not going to challenge them in fear of a lawsuit being filed. The world is no longer a safe place to live and people will try and do anything. As a male I am not concerned because if I run into it I will take swift action against any transgender or gay.

Failure to perform the duties of the office means abandoning your seat. Anything they did in the past is irrelevant and not voting the way you think they should is not misconduct. Also, what bathroom do you think transgender people use now? My goodness, these are not difficult concepts.

Ahh are you a lawyer? Maybe you slept at a holiday inn and think you are. If any of these commissioners have a felony conviction in their backgrounds they are gone plain and simple. One thing for sure there are many people in Salina and other places with very deep negative feelings towards the gay community and you never know what extreme they can take things. As mentioned prior there was no need for any change to the ordinance as these people were already covered by it just like all of us.

Just look at the picture and see how we were duped into voting for Aaron and Barb. When they were running for election both did not come across like this. jmmcc I know that is where you hang out is gay bars and Thomas Park. For the record I make no threats just tell it like it is. If I am approached by some gay in a men's room I will take appropriate action. But evidently you may be one of the transgenders alot of people been talking about or maybe just a pervert wanting to get into woman's locker rooms or toilets. Woman for the most part would not take any action like a male person would so they are at risk against this type of behavior. There is no way to monitor anyone trying to pull this off and then they have to be caught and arrested before it is brought to light. What a few here in Salina has done is caused an uproar where none was needed and not knowing any better probably you are one of the instigators.

This is not a law. It is a municipal ordinance that must first be heard in municipal court. everyone has the right to appeal to district court. District court can only rule on the parts of the ordinance that are supported by state law. Therefore no criminal or civil suit will withstand the dist court unless they have broken state law. We just wasted allot of taxpayer money. If Aaron is smart ( not so sure )they will not pass this on second reading.

@freewill, Any court above the local may find reason to uphold or overturn any judgement in city court. The perfect example is the case that was recently so public in NY where a city code prohibited gas exploration and the state upheld the city ordinance . Ks' discrimination act 44-1001 has a clause for "familial status" and I have a feeling the term could be used to justify an upheld conviction.

First of all administrator if you are going to delete the enforcer's comments you should be deleting a bunch more especially JMMcC. as for you JMMcC there isn't a gay that can beat anyone's butt and you definately need to come out of the closet. I don't intend to start a fight with you - but stuff like this is what makes me mad. Everyone jumps to stereo-typical conclusions such as, "oh..he stood up for gay rights, so he must be gay", or "well...he's gay, so there's no way that he could also be big and strong, too...cause gays are, by nature, weak and scrawny." It's all of this passing judgement stuff that gets me hopped up. What happened to "love thy neighbor"? I'm not suggesting that if you have a belief that you feel strongly about that you should just roll over on it. If you have convictions, stand up for them...but can't we do it without name calling and insults? There's just too much hate.

My question to you is how did you thumb your nose at Todd Pittenger and not get kicked off of here. He told everyone KSAL would not put up with anymore crap and you and your other id's came out and violated his decree immediately. The comments were reported but Todd did nothing how wrong is that to the rest of us that did not need lip service but wanted something done. All weekend without all those comments was great now looks like it starts over again how sad for all of us.

Getumgranny, you are stating the obvious. Laws don't often change minds. But it is a mistake for anyone to harbor the false notion that they are free to disobey the laws with which they disagree. If you were to try to present that as a defense in a lawsuit you would lose before a jury was ever seated. It is very easy to shift the burden of proof to you to prove that you had a legitimate reason to discriminate, and if you cannot come up with a good reason or the jury does not believe your story, then you can get out your checkbook and write checks for not only the damages awarded to plaintiff, but checks for your court costs and attorney fees and plaintiff's court costs and attorney fees too. Ignorance of the law can indeed be expensive.
