In their lawsuit, Thomas and Laury Snyder of Lecompton allege BNSF Railway Co.'s negligence led to the death of their 22-year-old son, Kyle, in November 2011. The crossing northwest of Lawrence had a sign but no flashing lights or gates.
A northeast Kansas couple whose son died when his truck hit a train is suing the railroad company.
In their lawsuit, Thomas and Laury Snyder of Lecompton allege BNSF Railway Co.'s negligence led to the death of their 22-year-old son, Kyle, in November 2011. The crossing northwest of Lawrence had a sign but no flashing lights or gates.
The couple filed the suit last week in Douglas County court.
Authorities said icy conditions contributed to the crash. The train's engineer and conductor said the pickup couldn't stop and slid in front of the train.
In September, state, county and railroad officials agreed to put signals and gates at the intersection crossing.
A spokesman for BNSF declined to comment on pending litigation.

It's a terrible tragedy - the railroad usually won't put up gates and signs till one or several get killed. I knew of one crossing where 3 people died before anything was done. This isn't the only crossing this has happened at and it is not going to be the last.

That is what happened West of Solomon on Old 40 some years back. Had been a deathtrap for years. Someone had to loose their life before the railroad would put up any lighted crossing signs.

Of coarse they are going to sue. Does this suprise anyone? Blood sucking, scum bag, money grubbing lawyers make it really easy to focus on money, money, money and forget all about personal responsibility.
