Charges Filed Against Grind Owner

Police raided the Grind on Thursday.
A Salina man whose business was raided by police last Thursday, appeared in court Tuesday morning to hear charges read against him.
Eric Srack, owner of the Grind, appeared in Saline County District Court before Judge Renee Young. The Judge said that Srack is charged with three counts of selling, delivering, or distributing compound JWH-081, an analog of JWH-018.
Salina Police say that JWH-081 is a synthetic form of the chemical Tetrahydrocannabinol (THC), which is found in marijuana.
Young said that each count carries a penalty of up to 51 months in jail and fine of up to $300,000.
The Grind has gained notoriety for selling a product labeled as "potpourri", which is not potpourri at all. It is instead a manufactured substance which teens have been smoking.
There have been numerous cases of those who ingest it getting sick, or having other ill-effects.
Since the raid on Thursday, groups of people have showed up at the store on West Ash Street to demonstrate both against, and for the business, which has been closed since the raid. A group of supporters has started a fund drive to help the business open again.
Judge Young scheduled a preliminary hearing in the case for March 9th at 1:30 in the afternoon.

lets hope the judge gives the max, having this guy off the streets for 153 months and 900,000 in fines would be a great start to help clean up all the misery he has caused. And I have heard that the owners of the building are going to make it into a parking lot.

I hope he doesn't spend a day in jail. People have been out to get him since he opened the store. I wish the police would do there job and put the real bad guys in jail, he deserves a fair trial and to be left alone.

"real bad guys"? like guys who sell a chemical substance to children and telling them to smoke it. A chemical substance that is made in a warehouse with who knows what going into it. A substance that is 500 times more powerful than weed. A substance shown to be addictive and cause who knows what kind long term effects. In some cases causes respiratory failure, extreme depression, seizures, and uncontrollable behavior. All so he can make money off of all the kids that he's sending to the emergency room. Ask someone with some knowledge. Ask a doctor or an ems professinal that has actually seen the effects of the stuff. As far as I am concerned he needs to be put away for a long long time. The judge in this case needs to make an example out of this scumbag.

I don't care for potpourri but the same people against this so bad are the same people ignoring larger topics. Nicotine, alcohol, chemicals in nearly all products, fast food health, obesity and nearly every other topic. It says not for human consumption. Hate him for having an illegal compound but hate your kids for abusing a product. If kids are smoking transformers tomorrow because the plastic gets you high are we going to crucify Hasbro?

For all the rumors out there that the Grind was selling bath salts, that is not true, i have never once seen them in the store, EVER! Potpourri has been around for years, only in Salina has there been such a huge issue made about it. If Eric would have had his business anywhere else, this would not be happening.

Missmanners what positive effects do fast food deliver? High fructose corn syrup? Meals at restaurants that hold over 2000 calories? Unnatural transfat? Cigarettes? Video game systems? Caffeine? Do you protest these? Or keep your mouth shut because they fulfill your addictions? I states before that your kids generation is dying 5-10 years earlier from obesity. Bet you still feed them slop too. Probably smoke cigarettes in the car with them. Guess where they get their addictive personality from? This store is obviously at fault for distributing a banned substance but start looking towards parenting and choices made by your kids. Tomorrow they'll be free basing monistat 3 and you can defend them once more.

How is the landlord to blame? A lease is binding until there is legal proof something illegal is going on in the property...have you checked with Lonnie's office to see if he is taking action to remove them from the building? JWH-081 is not specifically illegal. It is because it is substantially similar to JWH-018, which is illegal. JWH-081 is substantially similar to JWH-018, like water is substantially similar to hydrogen peroxide.

Chasity - it's not slander if it really happened and can be proven. Plus, he was stupid enough to put his "proposition" in writing, which my mother saved in case anything happened. How can that be argued with? And yes - i was a good enough kid to know getting involved with an older married man was a bad thing to do and I told my parents right away and quit hanging out with the people who we were mutually acquainted with. I can only imagine how many other young ladies are out there who were not as smart. I know of at least one other girl who was allowed to borrow cars from his lot whenever she wanted in exchange for certain things. (and that's not slander either) Now that he's got some product a lot of teens seem to want, I can't help but think he's worked out some sort of exchange system with a few of them. If the chemical compound is similar to that of THC found in marijuana, I highly doubt that the chemical is what is causing kids to get sick. Some things are not made to be smoked (Potpourri). Put this chemical on poison ivy and i'm sure kids will get sick too. Put this chemical on marijuana and i'm doubting that things happen. I don't think you're grasping the fact they're smoking POTPOURRI. Chemical or no chemical it isn't made to be consumed. Wonder why the chemical is illegal? Find something that it could be put on to smoke or digest without being sick and the fight to legalize marijuana is over and the country is bumming on bust money and distribution.

I am still baffled as to how your mother wouldn't drive straight down to the police station to prevent this from happening to other girls. I also agree that it is Salina and there probably wouldn't be any charges pressed immediately.BUT, if something like this is brought up is his trial (present), then they would have that file to turn to.. to help prosecute.

Apparently not, Srack sounds like a scumbag to me, however, I will be damned if I condone the gov coming in (whether it be state, local, or the feds) and "raiding" someone that IS NOT VIOLATING THE LAW.. For those of you that needs analog explained it means anything in that class of drug or it's family. This is in place because the criminal elements think they can just rename it and not get in trouble. I will not be suprised if interstate trafficing is not added to charges against Srack due to his internet bussiness. KS is behind other states in making this drug illegal, so if he sold and shipped this drug to the other states he can be held laible in those states as well.

This drug has been a problem since 1996 so there is a long history of research on it's problems associated with it's use. This is not a new band wagon to jump on for the users or those protecting the users from themselves and keeping non-users safe also and thos making and selling it. Read the links and you can clearly see the justification for the arrest. Yes Srack is not the only one in town selling it and I have faith in the legal system that when sufficient evidence against the others is obtained further arrest will occur. It was not a Witch hunt against Srack, but he was the one yapping the loudest about it in interviews and advertisments. As a result he was the first to be arrested.

I can't answer why they gave the stuff back to the individual at Pack Rat smokes. But I can tell you that the owner was charged with charges. Erik Srack had 2 buildings raided on Thurs. the raid was sponosored by the Federal Food and Drug administration and handled directly through the U.S. Attorney's office. The only thing SAPD did was raid the place. This whole investigation is being handled through the Feds.

@ sirsyko.. Yup, that is what the law says, so 081 is "similar" or an "analog", but jwh 250 isn't? Or any of the other of dozens of research chemicals? Co2 is just slightly different than CO, (1 oxygen molecule).. So who makes this call? Btw to the other poster citing fed regs, you do realize the fda let the temp emergency ban on these substances expire right? (That is why they waited btw, they were counting on that not happening I would assume, just a guess..) I don't think I want the police to say well its pretty close so bookem Dano! The law enacted to ban this drug did not expire. It went into effect on 24 Nov as a result of meetings prior in Oct. It takes 30 days for the new law to go into effect once it does it can remain in effect anywhere from 6 months to a year. This allows time to do further research on the drug. After that time period it can remain in effect if the evidence proves it to be a schedule I drug. For those of you old school people I am sure your recall a saying from grade school RIF, reading is fundamental. An informed mind can speak on the subject, all others is just conjecture. (look up the last word for it's meaning, which takes you back to RIF).

Put two molecules of hydrogen together with one molecule of oxygen, and you have water. Add another oxygen molecule and you have hydrogen peroxide. sirsyko you are missing the point the law does not just state any analog of the drug. It also includes schedule I drugs which means :. They will be designated as Schedule I substances, the most restrictive category, which is reserved for unsafe, highly abused substances with no medical usage. Your hydrogen peroxide comparison is a poor example. Hydrogen peroxide DOES serve a medical purpose and is approved by the FDA/DEA. It can not be abused not even if Srack used it to bubble up his drug. Bottom line hydrogen peroxide was not listed as a banned drug or it's analog. This "pope" however falls under the highly abused, unsafe, no medical purpose guidelines.

Srack was arrested because something he sold is 'substantially similar' to something that is against the law. The POINT is, who makes the determination? Hops, used to make beer is in the same family as cannabis. Some people could consider being in the same botanical family as being 'substantially similar'. Cannabis is illegal. What's to say somewhere down the line, someone won't decide hops are 'substantially similar'?

CHURCH not sure what point your trying to make, but try this on for size. The Fifth Amendment does not protect a person from being tried by two or more separate governments. Thus, both the federal government and the state government are able to charge and prosecute one person for the same criminal act, which is often the case for drug related crimes. As well, two or more states can prosecute and try a person for the same criminal act. That being said Srack can invoke his 5th ammendment until the end of time, his previous yapping along with sufficient evidence was enough to get him arrested and will be enough to get him convicted as well.

If you are trying to put someone in a cage for violation of the CSA/drug charges, its helpful if the drugs you have as evidence are against the law,(federal) in this case they are not. I have discussed this with a relative who is a prosecuting attorney in a DA's office in a large city. The video interview he gave to channel 12 with the veiled statement of "Talk to your friends to find out how to use this". This is not an exact quote ofcourse, but that statement proves intent for human consumption. Intent to distribute is what this is all about. And yes E. Srack has been convicted of previous drug related offenses and spent time in prison for these charges. He can claim the 5th amendment till he is blue. The interview he gave to a tv station is admissable in court and his drug dealing days should be over.The sad thing his family members who are posting on this venue think that it's acceptable. You're right, Ruby. I don't know the Srack's and I'm glad to say I don't. I didn't really know you guys that well 12 years ago either. What I did know that a 30 year old man handing a 15-year old girl a note asking her if she'd like to engage in a sexual relationship with him, and "check yes or no" at the bottom and give it back to him by sticking it inside a certain book for him to retrieve later, was perveted, pathetic and disgusting. Not at all smooth and something devoted to his family would do. Maybe THAT has changed in the last 12 years, I don't know. I just know that at that time, he obviously wasn't exaclty a stand-up guy and I've never stepped foot near him and his family again. From what I've said, I'm sure he knows exactly who I am, so I'm really not worried. He knows it happened. Maybe he stopped going after 15-year olds, but if history has taught us anything, that sort of tendency doesn't usually go away.

No I'm not associated with The Pack Rat in any way. I don't even know anyone who is. I did however work for Srack several times in the past. He's always been out to take advantage of whoever crosses his path just to make a buck. Whether it was fraudulently selling garbage on eBay, peddling second rate car audio and parts, selling crappy used cars (he was really good at it, go figure), furnishing alcohol to minors, and now all this potpurri s!@t. I never figured even Eric to turn to selling mind altering chemicals to kids, boy was I naive. Jail is the best place for him.There he will only be able to scheme and scam other criminals. Then his wife (great person by the way) can finally have a chance at leaving him and living a normal life. You know, the kind of life where you don't have to worry about your husband screwing teenage girls. The Srack family is all garbage, because of Eric, they will all be a lot better without him, just like the rest of the City of Salina.

I can also appreciate your defense of your father. But even children that are physically or verbally abused still cling to the parent inflicting the abuse. Just because someone is responsible for our creation does not make them a parent or worthy of our love and loyalty. especially if they abuse that position in any manner or are derelict in that responsibilty. I agree your father is not the only one to sell this drug. But he was the only one to advertise it, to speak to the media on countless occassions and to try to defend it. Whether he did so because he believed he was doing nothing wrong or because he was trying to convince others of his wrong ways only he knows. My belief and others as well is that it is wrong and he knew this and only cared about making money. He did say "Whatever it takes to pay the rent".

Although Eric wasn't always present in my life, he has made a very strong attempt in correcting the wrongs he has done. Although he is senile in his old age haha. He has made a tremendous impact in my life from the point in time I was able to hold an intelligent conversation of that comparable to those spoken over frequent chess games, or trying to teach me trick shots in a game of pool. Even the simplest things swinging tennis rackets at bee's in the backyard. He has shown me to be, although slightly crooked like myself, a noble and loving man. He has given me shelter, food, water, and clothes on my back. As well as his wife, my step-mother, has shown me mercy when I myself had no where to turn. They have given me their time and effort. I appreciate everything they have done for me, even to the little things like buying me a pack of cigarettes.

Whats sad is we have police chiefs going to jail for child molestation and people die from crack and meth overdoses and young girls are having children but I have seen more comments about a man selling "pope" than anything else. Have we really lost focus on what really matters this stuff was made for people who are addicted to pot and cant smoke it. People knew the risks and did it anyways same as alcohol and cigarettes yet the people who produce and market those products apparently are ok. Cigarettes and alcohol are far beyond Salina's control now, and at least there's an age restriction on them. Potpourri was being sold to minors. I've heard of someone as young as 13 being "addicted" to the stuff. It wasn't until she started vomitting uncontrollably that she told her parents what was going on. She also had great parents who discussed lots of things openly with her. This was before all the articles and news attention started, so they had no knowledge of potpourri until this occured. Unfortunately, both parents worked until 5 so they had no idea what was going on between 3:15 and then.

Kids at that age are very prone to peer pressure and lack the mental capacity to make great decisions for themselves. All she was told that it was something legal being sold to anyone and "everyone is doing it" and unfortunately, she fell for it. If Salina puts up a fight now, we have a better chance of getting rid of this stuff. Cigarettes and Alcohol are regulated by the FDA (I assume). This stuff is being thrown together by only God knows who in some warehouse in Salina without any studies or testing to make sure it's safe enough to distribute.
